TERMS & USAGE
⸺ TERMS
♡ I reserve the right to refuse projects or requests based on content, subject, or other reasons.
♡ There will be no shipping of physical goods as I am a digital artist and my work is digital only. If you want it printed, it is down to you to print it yourself.
♡ As the artist I still maintain all rights to my works; this includes publishing the work on my socials, adding it as a part of my portfolio, and including it in other projects, unless otherwise discussed with the client.
♡ Credits to me (© CONSTERMONSTER; the artist) or a link tracing back to one of my socials must be explicitly given anytime the art is showcased.
♡ No one is allowed to mint my artwork as a NFT (Non Fungible Token); my art, whether commissioned, pre-existing or future, can not be minted into an NFT by commissioner nor anyone else.
♡ Usage of my Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training or other for-profit platforms/ purposes,is strictly forbidden.
♡ Full payment must be sent before a commission is started, via PayPal invoice only.
♡ I do not allow refunds or cancellations unless I'm personally unable to finish your order. You can ask about your commission status or for WIPs anytime you desire.
♡ By purchasing my services (art), you agree that you have read and accepted all the terms described herein.
♡ You will agree here to the policy of using the art for personal, non-profit purposes unless otherwise stated.
⸺ RUSH FEES
♡If you need your finished piece quickly and wish for your commission to be PRIORITY, there will be an option to purchase a rush fee depending on how fast you want it to be done.
♡Rush fees are at least + 25% of the commission.Fees might vary depending on the project and the timeframe provided.
♡Details are to be discussed should the client have set dates.
⸺ USAGE
♡ My work is for personal use only- meaning I do not allow my art to be used for unauthorized commercial purposes or profit.
♡ Personal use means: display on social media accounts for promotional purposes with no direct monetization such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels.
♡ Clients receive exclusive, non-transferable usage rights to the artwork for personal use.
♡ Client must not change, modify, edit, trace or use the artworks in any way without prior permission from the Artist.
⸺ COMMERCIAL USAGE
♡ Commercial rights means usage of the artwork on streams or any monetized instances, or selling or reselling the artwork to another party, as a part of any product, or on another platform.
♡ Both the artist and the commissioner must agree beforehand about the use of the artwork commercially.
♡ In the case of a commission using one of my original characters, the character will still belong to me even if it is a commercial commission.
♡ The minimum price increase for any commercial use is 200% of the original price, meaning double the end sum. However, I reserve the right to charge more if I deem fit.
♡ The minimum price increase for any merchandise artworks is a one-time fee of +200% of the original price. However, I reserve the right to charge more if I deem fit. Promotional illustrations, stream assets, cover art, or any usage that could earn revenue is to be counted as commercial.
♡ Businesses, agencies, groups and other organizations should contact the Artist to discuss arrangements in more detail.
